A rescission period is simply defined as the amount of time you have to get out of the timeshare contract without penalty.  This time period is designed to protect people who bought a timeshare they didn’t really want due to high pressure and unethical sales tactics.

Rescission is a fancy way of saying cancellation or “cooling off” period. In every timeshare agreement, there is a section with all the information about your rights to cancel your agreement within a certain amount of time (your “rescission period”).  While the amount of time varies between jurisdictions, if done during the period stated in the contract, the consumer has full rights to get all their deposit back.

In the U.S., this time period can range from as little as 3 days up to 2-3 weeks after purchase depending on the state and resort you purchased your time share inThe actual rescission period may vary from state to state, and resort to resort. In Mexico, irrespective of whether its in a contract or not, there is a standard 5 day rescission period. In the U.K.,  there is a two week rescission period but everywhere else in Europe the standard is 10 days.

If you are regretting your impulse buy of a timeshare unit, you should act very quickly to get out of the contract within the rescission period.  It’s wise to hire an attorney who can look over any agreement you’ve signed to tell you what your rights are to get your money back.  This will prevent you from any mixups or disputes later on.

If your period of rescission has passed, most owners try to sell their timeshare or use a timeshare transfer service to help them get out of a financial obligation they no longer want or need.
